Supreme Court full court concludes, endorses amendment of SC regulations

KATHMANDU: A full court meeting called by Chief Justice Cholendra Shumsher JB Rana has concluded on Thursday afternoon.  The meeting attended by 18 agitating justices and chief justice endorsed a guideline relating to the assignment of cases through a system of drawing lots.  “The meeting also amended the Supreme Court Regulations,” a justice told Ratopati over the phone.  Once the guideline is published in the Nepal Gazette, the justices will be assigned cases by drawing lots. With this, the hearings, which have remained obstructed for the past three weeks, are likely to resume.  The justices have been boycotting the benches formed by Rana and hearing only the cases relating to the habeas corpus writ petitions for the past few weeks. In a bid to ‘safeguard the apex court’s sanctity, the Nepal Bar Association (NBA), an umbrella organization of the legal practitioners has been staging continued protests asking the Chief Justice (CJ) Cholendra Shumsher JB Rana to step down and give a way out.  Rana’s fellow justices at the court are also seeking his resignation amid the reports that he [Rana] claimed a share in the Sher Bahadur Deuba-led Cabinet.  CJ Rana was embroiled with controversies after he reportedly demanded a share in the incumbent Cabinet. Gajendra Hamal, a non-parliamentarian, was appointed the Minister for Industry, Commerce and Supplies on ‘CJ’s quota’. Hamal, a Congress leader, however, stepped down as the minister after questions were raised over his ‘controversial appointment’. The justices other than CJ Rana, who were boycotting all the benches assigned to them, however, began hearing the habeas corpus writ petitions amid the public outcry.  Though Rana has been assigning all sorts of cases, the justices have skipped all benches other than habeas corpus.

Full court summoned by Chief Justice Rana begins

Amid protests by NBA, Chief Justice Rana forms 10 benches

KATHMANDU: Chief Justice Cholendra Shumsher JB Rana has formed a total of ten benches to hear as many as 279 cases for Tuesday.  Despite the calls for his ‘immediate’ resignation by the Nepal Bar Association (NBA), an umbrella organization of lawyers, Chief Justice Rana has been assigning cases to his fellow justices at the Supreme Court (SC) for the past two weeks. The justices at the apex court, however, have been hearing only the habeas corpus writ petition following the public outcry. They boycotted all the benches for the initial one week.  The NBA has been staging protests on the SC premises for the past weeks demanding CJ Rana step down as the chief of the judiciary.  Rana was embroiled in controversy of late after he was accused of claiming a share in the Sher Bahadur Deuba-led Cabinet.

Dissident justices stay away from SC benches

Fifteen Supreme Court justices boycotted their benches today after Chief Justice Cholendra Shumsher JB Rana listed cases other than habeas corpus writ petitions in the cause list. Only two justices — Tej Bahadur KC and Manoj Kumar Sharma — who shared the bench heard the only habeas corpus writ petition.

CJ Rana assigns all sorts of cases to SC justices, 10 benches formed for Tuesday

KATHMANDU: Chief Justice (SC) Cholendra Shumsher JB Rana, who had been assigning only habeas corpus writ petitions to his fellow justices at the Supreme Court amid the ongoing deadlock, has, however, assigned other cases starting Tuesday.  In the cause-list published on Tuesday morning, CJ Rana assigned all sorts of cases including habeas corpus to other justices while his single bench is also scheduled to hear some cases.  Rana formed a total of ten benches --excluding his own, the other nine are joint benches.  Justices including Deepak Kumar Karki, Nahakul Subedi, Mira Khadka, Kumar Regmi, Hari Krishna Karki, Sushma Lata Mathema, Bishwambhar Prasad Shrestha, Kumar Chudal, Aanand Mohan Bhattarai, Prakash Kumar Dhungana, Anil Kumar Sinha, Prakash Man Singh Raut, and Sapana Pradhan Malla have been assigned cases for Tuesday.  Similarly, Bam Kumar Shrestha, Tej Bahadur KC and Manoj Kumar Sharma are also scheduled to bench the hearings on Tuesday as per the clause-list issued by the apex court.
