Supreme Court stays hearing on appointments in constitutional bodies

​​​​​​​The Supreme Court has issued an interim order asking its constitutional bench not to conduct hearing on the case filed against appointments in constitutional bodies as per the ordinances issued by KP Sharma Oli amending the quorum-related provisions of the Constitutional Council Act.

Hearing of writ petition filed against constitutional appointments today

KATHMANDU, March 18: The Constitutional Bench is scheduled to conduct a hearing on the writ petition filed against the constitutional appointments made by the then KP Sharma Oli government at the Supreme Court on Friday. The government-led by Oli had made appointments in various constitutional bodies after amending provisions of the Constitutional Council through an ordinance. Senior advocate Dinesh Triphati and advocate Om Prakash Aryal had then filed a writ petition against those appointments stating that the ordinance was against the constitution and appointments were made without conducting parliamentary hearings. They have also demanded to scrap those appointments.

Hearing of Supreme Court cases stalled

Hearing of cases at the Supreme Court remained stalled today as well, as 15 justices were busy discussing their next move against Chief Justice Cholendra Shumsher JB Rana, who faces accusation of seeking favour from the executive and delaying the hearing of cases filed against appointments to the constitutional bodies.

​​​​​​​Chief Justice Cholendra Shumsher JB Rana, who has been named a defendant in a case filed by Speaker Agni Prasad Sapkota, challenging the appointments to the constitutional bodies after the Constitutional Council Act was amended through an ordinance, submitted his written response to the Supreme Court.

Supplementary petition lodged against constitutional appointments

KATHMANDU, July 20: A supplementary petition has been lodged at the Supreme Court (SC) challenging the appointments made in the constitutional bodies at the recommendation of the Constitutional Council issuing ordinance by the KP Oli administration. Advocate Om Prakash Aryal registered the supplementary petition on Monday naming the Office of the President, Office of the Prime Minister and Council of Ministers and others as the defendants seeking to remove those appointed through the ordinances in different dates. The supplementary petition claims that a total of 52 appointments in different constitutional bodies are unlawful and unconstitutional. Likewise, the petition states that the recommendation process itself was unconstitutional.  Advocate Aryal had also lodged the first writ petition on 16 December, 2020.

Writ petition against the appointment of 20 constitutional officials

The Supreme Court on Wednesday has registered a writ petition that demands 20 officials appointed at various constitutional bodies removed from the position.
