SC denies to issue interim order sought by UML's Nepal faction

KATHMANDU, April 27: The Supreme Court (SC) on Monday ruled out giving an interim order in the writ petition filed by CPN- UML leaders  Madhav Kumar Nepal, Bhim Rawal, Ghanshyam Bhusal and Surendra Pandey. The four leaders had lodged the petition arguing that UML Chairman KP Sharma Oli took action against them by breaching the party statute.      A single bench of Justice Prakash Kumar Dhungana on Monday stated that such an issue is not deemed to be interim order and it could be reached to a conclusion after holding consultation between the two sides. The four leaders had lodged the petition on April 22 against the Election Commission of Nepal, CPN (UML) Chairman Oli, General Secretary Ishwar Pokhrel, Speaker of House of Representatives (HoR) Agni Prasad Sapkota  among others. The SC also asked to furnish a written response within 15 days through the Office of Attorney General.

SC justices to be assigned cases through lottery system

KATHMANDU: With newly amended Supreme Court (SC) Regulations being published in the Nepal Gazette, justices at the apex will now be assigned daily cases through a system of drawing lots.  The notice regarding the amended version of SC Regulations was published in the Nepal Gazette on Monday.  Though Monday’s notice in the gazette paved the way for the assignment of cases through the lottery system, an SC full court is required to take a decision to give it a formality.  The new provision replaces the prerogative that the Chief Justice enjoys while assigning cases to the justices at the apex court.  A report submitted by Justice Hari Krishna Karki had recommended introducing the lottery system. Another report by Justice Mira Khadka had also suggested the procedure to implement the system.  A full court held on November 18 decided to introduce a lottery system amending the existing provisions in the SC Regulations and endorsing a procedure regarding the new system.

Protests at SC continue, 20 arrested

KATHMANDU, November 15: The Nepal Bar Association staged a protest at the Supreme Court (SC) on Monday as well. The association has been staging a sit-in protest in front of SC since the past few days and was preparing for the same on Monday. The police have arrested as many as 20 individuals who were preparing for a sit-in and protest. Earlier on Sunday, more than 50 individuals were arrested by the police. It has been learnt that the police have arrested those who were at the SC to witness the protest. However, the police have maintained that they have arrested only those who were preparing to stage protests at the SC. The association has been staging protests at the apex court demanding the resignation of the Chief Justice Cholendra Shumsher JB Rana. Similarly, people have been witnessed taking to the streets in support of CJ Rana as well in recent days.

Nepal Bar Association to bar CJ from entering SC

KATHMANDU, November 12: The Nepal Bar Association (NBA) has announced bar the Chief Justice (CJ) Cholendra Shumsher JB Rana from entering the Supreme Court on Friday. “The bar won’t let (CJ) Rana enter the apex court today,” said Lilamani Poudel, the general secretary of the NBA. “Advocates are scheduled to gather at the SC at around 9: 30 AM in this regard,” Poudel added. The NBA is scheduled to stage a sit-in protest at the main gate of the apex court to avoid CJ Rana from entering the court. Meanwhile, the apex court is likely to bar advocates from staging a sit-in protest at the main gate of the apex court. As many as six advocates were injured on Thursday in the clash with security personnel at the SC. The NBA has been staging protests demanding the resignation of CJ Rana, accusing Rana of demanding his share in the Cabinet.

UML summons SC meeting

KATHMANDU, September 19: Communist Party of Nepal, (Unified Marxist Lenin), the main opposition party, has summoned its standing committee (SC) meeting on Monday. The meeting is scheduled for 12:30 PM today, Sher Bahadur Tamang, secretary of the party at the central office told Ratopati. The meeting has been called as a preparation for the Statute Convention of the party scheduled on October 1 to 3. The meeting will dwell mainly on three reports to be presented during the convention. Political, organizational and statute amendment proposals are to be submitted to the Statute Convention, according to secretary Tamang.

SC issues stay order on privatisation of NAC

KATHMANDU, July 26: The Supreme Court (SC) has issued an interlocutory order to stay put all the works related to privatisation of the Nepal Airlines Corporation.  The single bench of Justice Kumar Regmi issued the order to this effect here on Sunday. The interlocutory order reads, “All the works aimed at privatisation of the Nepal Airlines Corporation be put on whatever stage and states they are at. Do not make any decision regarding privatisation of the Corporation.” Atish Karki of Nepali Party, on behalf of NAC, had filed a writ petition demanding halt on all the works related to privatisation of the NAC.  Justice Regmi, upon the hearing on the writ petition, issued such an order. The apex court summoned both the parties on August 9 for discussion on whether to issue an interim order. Following the discussions, the SC will issue an order.

SC issues mandamus order to regulate Nepal-India open border

KATHMANDU, April 26: The Supreme Court (SC) on Sunday issued a mandamus order in the name of the government to regulate and control open border between Nepal and India.   A joint bench of Justices Prakashman Singh Raut and Purushottam Bhandari issued the mandamus order to regulate the open border between Nepal and India for Nepal's peace and security.   Responding to the writ petition filed by Senior Advocate Chandra Kanta Gyawali, lawyer Leeladhar Upadhyay and others on March 26, 2017, the SC ordered the government to remain serious on the issues of border between the two countries and to review the treaties.  The Government of Nepal has been asked to take initiative for the review of the agreements and treaties regarding the management and regulations of open borders between Nepal and India, as Nepal's sovereignty, geographical integrity, national unity, protection of welfare of the people of Nepal, economic prosperity and border security are government's significant constitutional responsibilities, reads the mandamus. The mandamus also asked the government to keep the record of those entering Nepal via land routes at immigration offices in the checkpoints under the task of border management for the safety of life and property of Nepalis and to stop misuse of border and encroachment.
