Hearing on HoR dissolution continues at SC

KATHMANDU, July 1: Hearing on the case related to the dissolution of the House of Representatives (HoR) continued at the Supreme Court Thursday too.  Former attorney general Agni Kharel has presented his arguments from the defendant’s side. Senior advocate Surendra Mahato also debated on behalf of the government on Thursday. The government attorneys finished presenting their arguments on Wednesday and lawyers from Prime Minister KP Sharma Oli began their arguments yesterday [Wednesday].  A total of 23 lawyers are scheduled to present their arguments from PM Oli’s side and some senior advocates took part in the debate on Wednesday soon after the government attorneys completed their arguments.   A total of four and half hours is remaining for defending the case from the PM's side as seven hours was allocated to them.  After the completion of PM Oli’s lawyers’ arguments, lawyers from the Speaker  Agni Prasad Sapkota will get time to present their arguments in the bench for an hour.   After responding to the court’s queries by defendants then amicus curiae will present their arguments on the case.    The hearing on the case is underway at the constitutional bench led by the chief justice Cholendra Shamsher JB Rana. Along with Rana the bench comprises justices Deepak Kumar Karki, Mira Khadka, Ishwar Prasad Khatiwada and Dr Ananda Mohan Bhattarai. Twenty six writ petitions were filed against the dissolution of the House of Representatives. On May 22, President Bidya Devi Bhandari, at the recommendation of the Council of Ministers, dissolved the House of Representatives and fixed November 12 and 19 as the date for mid-term election. The petitioners seek declaring the President's decision as unconstitutional and illegal, and reinstatement of the House of Representatives.

Hearing of writ petition filed against appointment of IGP begins

KATHMANDU, June 13: Hearing of the writ petition filed against the appointment of Inspector General of Nepal Police is currently underway at the Supreme Court (SC). The hearing is being conducted by a joint bench of acting Chief Justice Deepak Kumar Karki and Justice Kumar Chundal. Earlier on May 1, 2022, the Cabinet had decided to appoint Diraj Pratap Singh to the post of IGP of Nepal Police. Later, AIG Bishwaraj Pokharel had filed a writ petition at the apex court accusing the government of not making the appointment on the basis of seniority.

SC starts hearing on habeas corpus cases

KATHMANDU: Hearing on habeas corpus cases has started in the Supreme Court today. The hearing is taking place in nine benches.   In a week, the hearing on habeas corpus case had taken place on Monday. But on Tuesday, haring even on the detainee case was not possible.  Chief Justice Cholendra Shumser JB Rana had scheduled benches to hear the habeas corpus cases. Six of them are division and two are single, according to SC Spokesperson Baburam Dahal.  It may be noted that judges at the SC had refused joining the hearing session since Monday afternoon putting forth various demands  The hearing had remained completely affected since October 25.  The disruption in the hearing procedures has affected service seekers arrived from far flung parts of the country.

Hearing begins on HoR dissolution case

KATHMANDU, June 25: Hearing into the case related to the dissolution of the House of Representatives (HoR) is underway on Friday as well. Today is the third day of continuous hearing on the case at the Constitutional Bench chaired by the chief justice Cholendra Shamsher JB Rana. The writ petition filed by Nepali Congress President Sher Bahadur Deuba with the back support of 149 lawmakers is being regularly heard in the Supreme Court from Wednesday.  In today’s hearing from the petitioner’s side, senior advocate Shreehari Aryal has started the pleading at the court.  Aryal argued that the interpretation of the Article 76 (5) while forming the government by the President was against the constitution. The SC has allocated 15 hours each to both petitioners and defendant sides on the case.

SC orders govt not to implement Citizenship Ordinance

KATHMANDU, June 10: The Supreme Court (SC)on Thursday issued an interim order in the name of the government not to implement the Citizenship Ordinance-2021.  Hearing on the writ petitions registered at the apex court against the Ordinance, which was issued by President Bidya Devi Bhandari at the recommendation of the Council of Ministers, a Constitutional Bench headed by Chief Justice Cholendra Shumsher JB Rana said that implementation of ordinance can not be judicially justified.  The Bench comprises Justices Dipak Kumar Karki, Mira Khadka, Hari Krishna Karki and Ishwar Prasad Khatiwada besides Rana.  After President Bhandari issued the Ordinance on Citizenship on May 23, a day after she dissolved the lower House of parliament, a total of six writ petitions were registered at the Supreme Court (SC)  claiming that the ordinance does not go in line with the spirit of the Constitution of Nepal.

Hearing on proposed SC judges on April 16

The parliamentary hearing on the proposed judges for Supreme Court, Kumar Chundal and Nahakul Subedi, is scheduled for April 16, according to Committee's President, Laxman Lal Karna. The meeting of the Parliamentary Hearing Committee held today garnered information from the complainants against the proposed judges. There were two complaints against proposed judge Chundal while five against Subedi. Among five complainants against proposed Justice Subedi, four attended the committee meeting and put forth their views. The meeting discussed thoroughly on the questions raised over capacity and other issues against the proposed judges, according to President Karna. However, those against Chundal did not attend the meeting.
