SC justices to be assigned cases through lottery system

KATHMANDU: With newly amended Supreme Court (SC) Regulations being published in the Nepal Gazette, justices at the apex will now be assigned daily cases through a system of drawing lots. The notice regarding the amended version of SC Regulations was published in the Nepal Gazette on Monday. Though Monday’s notice in the gazette paved the way for the assignment of cases through the lottery system, an SC full court is required to take a decision to give it a formality. The new provision replaces the prerogative that the Chief Justice enjoys while assigning cases to the justices at the apex court. A report submitted by Justice Hari Krishna Karki had recommended introducing the lottery system. Another report by Justice Mira Khadka had also suggested the procedure to implement the system. A full court held on November 18 decided to introduce a lottery system amending the existing provisions in the SC Regulations and endorsing a procedure regarding the new system.

SC hearing six cases on Monday including a bench headed by CJ Rana

KATHMANDU, November 8: Hearings on six cases are scheduled to be conducted at the Supreme Court (SC) on Monday. Chief Justice (CJ) Cholendra Shumsher JBR has assigned six benches on Monday including himself on Monday. Of the six scheduled cases, CJ Rana will be hearing the case accompanied by Justice Kumar Chumdal. Nepal Bar Association (NAB), an umbrella organization of legal practitioners, asked CJ Rana not to bench any cases following controversies in the judiciary. All the hearings to be conducted on Monday are related to habeas corpus cases. Following protests by the Nepal Bar Association, the association and his fellow SC Justices demanded that CJ Rana resign from his post. CJ Rana has been accused of claiming his share in the Cabinet.

Joint meeting of SC justices begins, full court meeting still uncertain

KATHMANDU, October 25: A joint meeting of Supreme Court (SC) justices have begun. Even if the Chief Justice (CJ) Cholendre Shumsher JBR had summoned a full court meeting for Monday, SC justices sat for a joint meeting. Due to the joint meeting, the full court meeting called by CJ Rana has fallen into limbo. Similarly, as many as 14 SC justices have already decided to boycott the full court meeting summoned by CJ Rana. Besides, the Nepal Bar Association has urged the authorities concerned to take effective actions immediately as the Judicial body has been involved in controversy due to CJ Rana himself. Meanwhile, at the time when the CJ and other justices are facing disputes, some of the apex court justices are touring Khaptad and the United States of America. Justice Sapana Malla Pradan and Anil Kumar Singh are currently in Khaptad while justice Ishwar Prasad Kathiwada is in the USA. Likewise, justice Nahakul Subedi took an urgent leave on Monday along with justices Tej Bahadur K.C and Dr Kumar Chudal.

Justice Regmi to bench writ petition filed at SC against appointment of Ghising

KATHMANDU, August 18: Hearing on a writ petition filed at the Supreme Court (SC) against the appointment of Kul Man Ghising on the post of the Managing Director (MD) of Nepal Electric Authority (NEA) is to be benched by Justice Kumar Regmi. Earlier, Hitendra Shakya, outgoing MD of NEA had filed a writ petition at the apex court demanding to scrap Ghising’s appointment on August 16. Shakya in his petition claimed that he has not received any formal letter from the government regarding relieving him from his post and Ghising’s appointment is against the law. Earlier, the Council of Ministers appointed Ghising as the MD of NEA as proposed by the Ministry of Energy, Water Resources and Irrigation.
