SC scraps writ petition filed against citizenship ordinance

KATHMANDU, March 16: The Supreme Court (SC) scrapped the writ petition filed against the citizenship ordinance on Wednesday. A joint bench of acting chief justice Deepak Kuamr Karki, justices Meera Khadka, Hari Krishna Karki, Ishwar Kathiwada and Ananda Monhan Bhattari took a decision to this effect. Earlier, senior advocate Borna Bahadur Karki had filed three petitions against the ordinance. The then KP Sharma Oli-led government had introduced the citizenship ordinance on May 23, 2021. The apex court had then ordered not to implement the ordinance on June 10 the next month.

Oli, Prachanda sharing same stage in a year’s time

KATHMANDU: KP Sharma Oli and Pushpa Kamal Dahal ‘Prachanda’, who were once two chairmen of the erstwhile Nepal Communist Party (NCP),  have shared the same stage in a hiatus of a year, thanks to the ongoing general convention of ruling Nepali Congress (NC).  The bittering relation between two former prime ministers was further intensified after Oli dissolved the House of Representatives (HoR) twice --- December 20, last year and May 22.  The two leaders were formally compelled to maintain further distance as the Supreme Court (SC) invalidated the NCP and revived the parties led by them --- Oli-led CPN-UML and Prachanda-led CPN (Maoist Center). UML and Maoist parties were merged to form NCP in May 2018.  Meanwhile, Oli is sharing the same NC General Convention’s stage with his former party leader, Madhav Kumar Nepal nearly after five months.  Nepal, after leading the dissident faction in the UML for months, formed a new party named CPN (Unified Socialist) in August.

The Supreme Court (SC) has ordered an original copy of the file pertaining to the party disassociation after hearing the writ petition regarding the dismissal of 14 lawmakers recommended by the CPN UML.

Writ petition filed at SC against recent Cabinet reshuffle

KATHMANDU, June 7: A writ petition has been registered at the Supreme Court (SC) against the ‘unconstitutional’ reshuffle of the Council of Ministers  by Prime Minister KP Sharma Oli on Friday, last week.  Senior advocate Dinesh Tripathi and advocate Kanchan Krishna Neupane, on Monday, registered the writ petition claiming Friday’s  reshuffle.  Petitioners argued that PM Oli, who has remained as the caretaker prime minister as he failed to win trust vote in parliament, could not reshuffle the Cabinet.   PM Oli made several changes in his Cabinet on Friday relieving some of the ministers from his party, CPN-UML while  picking ten  others from the Thakur faction of the Janata Samajbadi Party (JSP).

SC annuls appointment of seven minister including Home Minister Thapa

KATHMANDU, May 20: The Supreme Court (SC) has issued an order to scrap the appointment of seven ministers in the KP Sharma Oli-led Cabinet.  Responding to a writ petition filed against the appointment of seven ministers, who are not the members of the federal parliament, a single bench of Chief Justice Cholendra Shumsher JBR, on Thursday,  invalidated the appointment of the ministers including Home Minister Ram Bahadur Thapa as per Article 78 of the constitution. Prime Minister Oli appointed seven ministers on May 14 after he was reappointed as the Prime Minister on May 13.  With this, Home Minister Ram Bahadur Thapa, Industry Minister Lekhraj Bhatta, Energy Minister Top Bahadur Rayamajhi, Urban Development Minister Prabhu Shah, Drinking Water Minister Mani Thapa, Labor Minister Gauri Shankar Chaudhary and Sports Minister Dawa Lama have been relieved of the member of Cabinet.  Advocates duo Kapil Dev Dhakal and Rabiraj Thapa filed the writ petition demanding to scrap their appointment.

SC denies to issue interim order sought by UML's Nepal faction

KATHMANDU, April 27: The Supreme Court (SC) on Monday ruled out giving an interim order in the writ petition filed by CPN- UML leaders  Madhav Kumar Nepal, Bhim Rawal, Ghanshyam Bhusal and Surendra Pandey. The four leaders had lodged the petition arguing that UML Chairman KP Sharma Oli took action against them by breaching the party statute.      A single bench of Justice Prakash Kumar Dhungana on Monday stated that such an issue is not deemed to be interim order and it could be reached to a conclusion after holding consultation between the two sides. The four leaders had lodged the petition on April 22 against the Election Commission of Nepal, CPN (UML) Chairman Oli, General Secretary Ishwar Pokhrel, Speaker of House of Representatives (HoR) Agni Prasad Sapkota  among others. The SC also asked to furnish a written response within 15 days through the Office of Attorney General.
